Acceptance of Terms
The customer acknowledges having read, at the time of placing the order, the specific terms of sale presented on this screen and expressly agrees to them without reservation.
These general terms and conditions of sale govern the contractual relationship between Club des Strass and its customer, both parties accepting them without reservation. These terms prevail over any other terms in any other document, unless a prior, explicit, and written exemption has been agreed upon.
Products
Images representing the products are not contractually binding. Club des Strass cannot be held responsible for any errors.
Orders
An order is effective upon receipt of your payment and the sending of a confirmation email. Club des Strass reserves the right to refuse or cancel any customer order, particularly in the case of a dispute relating to the payment of a previous order.
Delivery
Made-to-Measure Products: delivery times begin upon receipt of a 30% deposit and are provided as an estimate on each order confirmation. Delivery delays cannot give rise to a claim for damages by the buyer, nor result in the cancellation of the order.
In case of apparent defects, the buyer has the right to return the product under the conditions stated in this document. You have 48 hours to report any missing or damaged items to the carrier.
Right of Withdrawal for Non-Made-to-Measure Products
You have 15 days from the date of receipt of the items to change your mind. For exchanges or refunds, return the item in new condition and in its original packaging; otherwise, the request will be refused.
In exercising the right of withdrawal, Club des Strass must refund the amounts paid by the customer, without fees, except for return and shipping costs. Refunds are due within a maximum of 15 days.
The customer does not have the right of withdrawal for products made-to-measure, as they are considered clearly personalized goods according to the consumer’s specifications under Article L221-28 of the French Consumer Code.
Payment
Prices are expressed in euros.
The price indicated in the order confirmation is final, including all taxes (VAT for France and EU countries). This price includes the product cost, handling, packaging, storage, shipping, and setup fees.
Disputes
This contract is governed by French law. Club des Strass cannot be held responsible for any material, immaterial, or bodily damages resulting from misuse or malfunction of the products. The same applies to any product modifications made by the manufacturers. Liability is limited to the order amount and cannot be invoked for minor errors or omissions despite all precautions taken in presenting the products. Seeking an amicable solution does not suspend the legal guarantee period or contractual warranty. Compliance with this contract’s warranty terms generally requires the buyer to fulfill their financial obligations toward the seller.
Claims or disputes will always be treated with care, assuming good faith on the part of the customer. In case of a dispute, the customer should first contact the company to seek an amicable solution.
Sketch Ownership
The sketch designed by Club des Strass remains the exclusive property of Club des Strass. Submitting this sketch to another tailor is strictly prohibited. Any sketch not followed by an order will be charged €5 including VAT.
Leotard Measurements Responsibility
Club des Strass is not responsible for the leotard size if measurements are taken incorrectly.
Deposit and Order Cancellation
Once the deposit is paid, the order cannot be canceled, and the deposit is non-refundable.
Leotard Care
Club des Strass assumes no responsibility for leotard care. A care sheet will be provided to guide you in maintaining the rhinestones optimally.
Delivery Delays
Club des Strass cannot be held responsible for consequences resulting from delivery delays beyond its control. These terms aim to ensure clear understanding of purchase conditions while protecting the interests of both Club des Strass and its customers.
Data
Providing personal information for distance sales is mandatory, as it is necessary for processing and shipping orders, generating invoices, and issuing warranties. Failure to provide this information will prevent order validation. In accordance with the “Informatique et Libertés” law, the processing of personal data has been declared to the French Data Protection Authority (CNIL). Customers have the right to access, modify, correct, and delete their personal data (Article 34 of the January 6, 1978 law). Club des Strass commits not to share customer data with third parties, either free of charge or for compensation.
